Eight tourists accused of gang rape of young Briton in Magalluf accept 72 years in prison

The eight defendants accused of gang rape of a British tourist in Magalluf in August 2023 have admitted to the crimes and accepted a total of 72 years in prison as the alleged perpetrators of six counts of sexual assault and eight counts of invasion of privacy.

The parties involved in the case reached an agreement on Monday morning before the Second Section of the Balearic Provincial Court held the trial in Palma. Under this agreement, the eight defendants, all of French nationality except for one Swiss national, have admitted that on 14 August 2023 they went to a hotel room in Magalluf where one of them was staying, accompanied by the victim.

For approximately half an hour, knowing that the woman was unconscious, they stripped her naked, subjected her to sexual touching and raped her multiple times. According to the prosecutor’s indictment, they made obscene comments and recorded 21 videos of the sexual assaults on their mobile phones, which they later shared via an instant messaging app.

The eight defendants were remanded in custody a few days after the events took place. The prosecution initially requested that they be sentenced to a total of 153 years in prison and ordered to pay €190,600. Following the plea agreement, which takes into account the mitigating circumstance of compensation for damages, as civil liability has already been paid, the sentences have been reduced to a total of 72 years and three months in prison.

All have been sentenced to two years or two years and three months as alleged perpetrators of crimes against privacy and six for different degrees of sexual assault. With regard to the crimes of sexual assault - of which two of them are not accused - the sentences vary according to the seriousness of the crime.

Two of the defendants have been sentenced to 13 years and three months in prison, one to 13 years, two to 11 years, one to six years and three months, and two to two years and three months. At the end of the hearing held on Monday morning, the magistrate read out the guilty verdict orally, pending its formal drafting.
