A court in Palma has passed sentences of two to five years on five men who beat a man, then aged 22, so severely that he was left permanently incapacitated and dependent on others to care for him.
This case dates back eleven years. On August 16, 2015, there was an altercation between the victim and the brother of one of the five in Puerto Alcudia's nightlife area. They attacked him. One kicked him in the head, causing him to lose consciousness and begin convulsing. They then continued to kick him in the head.
He suffered a severe traumatic brain injury with an occipital fracture and several internal injuries that required subsequent medical and surgical treatment. His injuries took 205 days to heal. He suffers from a cognitive disorder and very serious neuropsychological damage, including amnesia, false recognition, and has complete dependence on another person for all activities of daily living. On September 30, 2019, a court in Alicante declared him legally incapacitated and appointed his father as his guardian.
The Prosecutor's Office had initially called for eleven-year sentences for each of the five. An agreement between the prosecution and defence reduced these sentences, while the court also ordered that they pay the victim compensation of €1,120,000 plus €71,000 to his sister.
Mitigating circumstances were applied in that two of the defendants paid €10,000 to the victim before the trial. It was also taken into account that they had acted under the influence of alcohol and drugs. Further agreement means that none of the five will go to prison. The sentences were suspended, as suspension does not exceed legal limits after the agreed reductions.
