Community of owners president in Mallorca accused of embezzlement

The community of owners for apartments in Puerto Alcudia have accused the former president of embezzling at least €129,000; he was the president for some thirty years. The owners have filed a lawsuit requesting a criminal investigation into the ex-president, who was also the property's administrator and was on the payroll. He took a monthly salary of €3,000 for handling the likes of collection of community charges and organising maintenance.

When he was replaced, an analysis of the accounts began to reveal suspicious activity. According to the lawsuit, there are multiple irregularities in the accounts: recorded income that does not correspond to actual cash inflows, cancelled debts, and a movement of funds between community accounts that does not correspond to any real activity and is not justified by invoices or any other type of documentation.

The report on which the lawsuit is based concludes that these irregularities resulted in financial losses for the owners. The president collected residents' fees in cash, but the income in the account does not balance.

There are other alleged items, the cost of which has yet to be quantified. These include the use over several years of a community space for operating his private estate agency business. The president allegedly drew up a lease agreement for this in exchange for €2,000 per year, well below market value. No record can now be found of that amount ever having been paid.
