Sebastián Martorell, found guilty of the homicide of 32-year-old Jaume Llabrés in Inca in 2020, has been sentenced to seven years.
The sentence was passed by the Provincial Court in Palma on Friday, Sebastián Martorell having been found guilty of the fatal stabbing of Jaume Llabrés, who had broken into his property and attempted to steal marijuana plants. A homicide verdict was given, the jury in the trial having ruled out murder as it did not find evidence of premeditation.
The judge accepted a jury opinion that Sebastián Martorell had acted out of fear. This and the fact that he had cooperated with the Guardia Civil were taken into account as mitigating circumstances in passing sentence. This is in the lower range for homicide (a maximum of 15 years).
He also been ordered to pay Jaume Llabrés' family €157,875 in compensation for emotional distress.
The three men who had gone to the property with Jaume Llabrés on September 24, 2020, but who had remained outside were each sentenced to twelve months for attempted robbery.
