A witness to last Sunday's fatal accident in which a three-year-old girl died claims to have seen the driver using his phone shortly before his car mounted a pavement and ran the girl over.
Palma Police are still finalising the details of the official report that will be submitted to the investigating court. As part of the investigation, the phone was taken for examination; the police still have it. Officers found the phone in the car's centre console.
The accident occurred around quarter past twelve on Sunday. Three-year-old Elena, her mother and her grandmother were among a number of families who were walking to the Collerense football ground.
The driver's partner has told police that the man had been driving erratically, hitting kerbs. There were tyre marks in the area, but these weren't necessarily from his car. The police's main line of investigation has been that this was a tragic accident caused by some form of indisposition that the driver had suffered. His partner's statement backs this. He tested negative for alcohol and drugs.
